Surgery to replace the Guidant ICD defibrillator is not cheap. The unit may cost between $10,000 and $20,000. Then there is the cost of the surgery - sergeon and operating room setting, anesthesia, nurses. Also there is the cost of post operative care. In addition, there can be additional medical costs if there are complications.
These costs may be covered by health insurance. Of course, that means that the cost of insurance permiums in the future will include the costs of these mistakes made by Guidant.

Who is responsible for paying for my Guidant ICD defibrillator replacement surgery costs?
The cost of this should be born 100% by Guidant. It is not fair to burden insurance companies. Further, for those without insurance, it is even more unfair to burden the US taxpayer. Thus, it is imporant that the public support efforts to hold Guidant directly accountable. Otherwise, the burden will ultimately shift to the public taxpayer or worker (in the form of higher taxes or insurance premiums).
It is very upsetting to see a company use its profit motive in this manner. Where they make money from a device, and then when it is discovered to be defective, only offer partial repayment, leaving the taxpayer to pick up the broken pieces.
There is however a counter balancing power. That power rests in the American jury system. It is only in a jury trial that big companies like Guidant can be held accountable to the simple citizenry. We believe that through jury trials, Guidant will ultimately be held responsible to pay for the total cost of replacement surgery for ICD defibrillators. And we are not simply referring to the cost of the unit, but to all of the associated costs, including surgery cost, follow up care, inconvenience, wage loss, as well as pain, suffering and loss of life's pleasures for those harmed by these defective devices.
