JURY FINDS FOR MERCK IN VIOXX CASE

A jury has found the drug maker properly warned consumers about Vioxx risks. The finding means Merck will not be held liable for the 2001 heart attack suffered by a man who was taking the painkiller. The case revolved around whether Merck & Co. could be held liable for the heart attack suffered by an Idaho postal worker and whether Merck misled the public about the arthritis drug's cardiovascular risks. This is the second Vioxx lawsuit to go to trial; the first case in Brazoria County, Texas, returned a verdict in favor of the plaintiff. The Associated Press, 11/03/2005
