Individual personal injury actions, consolidated by state courts for efficiency purposes, are not class actions. Yet these cases would nonetheless be federalized under a proposed class action bill. The bill even invents a new term for these cases "mass actions" to make it appear they are an appropriate subject for inclusion in a class action bill. They are not. Federalizing these individual cases would delay the judicial process exponentially for persons suffering very real physical injuries such as the people injured by Vioxx.
