A recently enacted Texas law has made it more difficult to recover damages from drug companies based on an alleged failure to warn. Under this new law, if a drug manufacturer proves that its warnings were approved by the U.S. Food and Drug Administration, then there will be a presumption that the drug maker is not liable. This presumption can be overcome, however, if it can be proved that the drug maker either withheld information from the government or misrepresented information to the government.
