When an accident occurs, and the other driver does not have insurance, and you are hurt, then your UM/UIM takes the place of the uninsured, or underinsured, person who injured you.
But this does not mean that your insurance company will just pay you without a fight. Now they will stand in the shoes of the person who hurt you.
Thus, with uninsured (UM) and underinsured (UIM) motorists it is still important to consider hiring a lawyer.
When an underinsured driver injures you, your own insurance company becomes your adversary, and you will probably need a lawyer to get a fair settlement.
