MERCK SAYS PLAINTIFF IN FIRST SCHEDULED VIOXX TRIAL LIED, MOVES TO DISMISS CASEAccusing the plaintiff in the case of lying, drug
manufacturer Merck & Co. asked a judge to dismiss the
first scheduled trial over its now defunct Vioxx pain
reliever, which is slated to beginin May. Cheryl
Rogers of Alabama filed a wrongful death lawsuit on
behalf of her husband, who she claims took Vioxx
samples provided by his doctor. However, Merck says
those pills didn't leave the company's possession
until about six months after Rogers' husband died.
