FEN-PHEN SETTLEMENT PLAN SPLITS PLAINTIFFS' LAWYERS

Pressure from Wyeth Pharmaceuticals to resolve protracted fen-phen litigation is dividing the ranks
of plaintiffs' lawyers representing clients who claim the diet drug cocktail caused their heart and lung
damage. The New Jersey-based pharmaceutical giant announced in January that it is negotiating with
attorneys representing nearly 60,000 outstanding claims from individuals who opted not to join a $3.75
billion class-action settlement. The proposed agreement would provide $20,000 to claimants who can't
prove they took the drugs for 90 days or more, and pay damages on a graduated scale to the remaining
claimants, based on the severity of their injuries. But several prominent plaintiffs' attorneys -
representing thousands of clients - told Lawyers Weekly USA that they are rejecting Wyeth's group
settlement offer. They said that despite the length and complexity of ongoing fen-phen litigation they
are determined to try their clients' cases in court. Michael J. Miller, a plaintiffs' attorney in
Alexandria, Virginia, said a coalition of about 40 law firms - representing some of the largest and most significant fen-phen cases awaiting trial - have dismissed Wyeth's settlement plan.

Consumer Group Urges Ban of Celebrex


COX-2 inhibitors have been widely popular for use as pain killers and anti-inflammatory drugs with fewer stomach and intestinal side effects than such products as aspirin. Pfizer shares fell 22 cents to US$24.26 in Monday trading on the New York Stock Exchange, up from a 52-week low of just under $22 in December.

Neither the FDA nor Pfizer responded immediately to requests for comment on Public Citizen's petition.
