Medical Monitoring Class Action Filed in Tennessee Vioxx Case: Summary by: Michael Monheit, Esquire - Monheit Law, PC

Nashville area woman files lawsuit against Merck (the maker of Vioxx) for risk of stroke or heart attack. Barbara Cathey, asks for a class to be certified as in Hickman County Circuit Court against pharmaceutical firm Merck & Co. The suit was filed Nov 22,. 2004.The suit differs from other Vioxx cases because it is not a personal injury claim. The class action seeks medical monitoring for Cathey and other similarly situated plaintiffs who were Vioxx users for more than 18 months but who have not suffered a stroke or heart attack. They are seeking for Merck to pay for medical monitoring.
