The Food and Drug Administration
has stepped up efforts to investigate ephedra strokes and ephedra heart attacks and possibly ban the use of ephedra in products like Twin Lab Ultra Fuel, Ultracarb Weight loss, or other diet pills with Ephedra. In August 2002,
the FDA demanded that Metabolife International turn over their records of
some 13,000 consumers' complaints of adverse reactions to their products, including numerous ephedra strokes, ephedra heart attacks and ephedra TIA's.
Metabolife complied with the request only after facing possible criminal
charges for withholding the records regarding ephedra and injuries such as ephedra heart attacks, ephedra strokes and ephedra TIA.
The Federal Trade Commission has levied heavy fines against the makers and
distributors of diet pills with Ephedra. In April 2000, Enforma Natural Products, which
advertised and sold "The Enforma System," agreed to repay $10 million to
customers to settle FTC charges that they used false claims about scientific
testing. Other companies have also been required to pay fines to the
government.
Courts have awarded settlements to individuals who have been harmed by
products such as Twin Lab Ultra Fuel, Ultracarb Weight loss, or diet pills with Ephedra. A jury in Alaska awarded $13.3 to a woman who
suffered an ephedra stroke after taking a weight-loss product containing ephedrine in
February 2001. Between 1994 and mid-1999, supplement companies settled nearly
three dozen personal-injury and wrongful-death lawsuits involving ephedra heart attacks or
ephedra strokes. Many more suits are pending, many of which involve ephedra stroke, ephedra heart attacks or ephedra TIA's.
