Working with a Workers Comp Lawyer on a Contingent Fee Basis

No Recovery, No Fee. When you work with a lawyer on a contingent fee basis, you eliminate a great deal of risk for yourself. A contingent fee arrangement is one where the attorney only gets paid if you win your case. The fee is "contingent" on winning. This is probably the best way to hire an attorney for your workers comp case. Most attorneys work on a contingent fee in the 15-20% range. In many states, the percent an attorney can charge is regulated. In Pennsylvania, the maximum fee is 20%.

Cheaper does not mean better. You may not want to hire the "cheapest lawyer" anymore than you might not want to buy the cheapest car. Not all lawyers are the same in their experience. You want to check into the track record of the attorney you are hiring and take that into account in determining what is a fair fee for their services.

I win if you win. By hiring an attorney on a percentage of the recovery (contingency fee), your interests are highly aligned. The more that the attorney can recover for your case, the higher the fee. Thus, you both want to get as much as possible.

I don't get paid until you get paid. Again, this helps keep your interests in line with your attorney. When an attorney is paid by the hour, the client is taking all of the risk. When an attorney is paid only when the case is won, they have an interest in getting the case resolved as soon as possible.
