This will determine which entity may claim immunity from a common-law action under the exclusive Workers Compensation Act.

The test to determine whether a worker furnished by one person to another becomes the employee of the person to whom the worker is loaned is whether the worker passes under the latter's right of control with regard not only of work to be done but also the manner in which the work is performed.
