Section 301(c)(1), 77 P.S. §411(1), of the Pennsylvania Worker Compensation Act

Section 301(c)(1), 77 P.S. §411(1), of the Pennsylvania Worker Compensation Act defines a work related injury as follows, "an injury to an employee, regardless of his previous physical condition, arising in the course of his employment and related thereto ." Furthermore, there has been recent and significant litigation addressing the issue of whether a claimant's death is due to an underlying cardiac condition and should be compensable. The courts appear to have resolved this issue by requiring a careful review of the medical testimony presented to determine its substance rather than its form. Where physical work activity triggers angina and contributes to accelerated coronary artery disease, establishing existence of abnormal working conditions is not an element of claimant's prima facia case. Curren vs. WCAB (City of Chester), 863 A2d 624 (Pa.Cmwlth. 2004).
