Body Parts lawsuits in USDC New Jersey

Our firm is now working closely with lead counsel in the National Class Action captioned Vitola vs. Biomedical Tissue Services, Ltd., et al. This case is presently pending in the United States District Court for the District of New Jersey. This litigation arises out of the harvesting, processing, distribution, sale and implantation of human "body parts" for several years up to November, 2005. In November of 2005 the FDA provided notice to many doctors and hospitals throughout the Country that they had received "body parts" for surgical procedures that were illegally obtained from corpses without proper screening for certain infectious diseases. The lead Plaintiff, Anthony Vitola, was the recipient of a cervical disc in July of 2005 when he had back surgery. His doctor, Dr. Fernando Delasotta was advised by the FDA that defendant Biomedical Tissue Services was discovered to have been involved in this scheme, and that the materials he had used for Mr. Vitola's surgery were illegally obtained.

The body parts involved include, among other things, bone, skin, tendons, teeth, etc. Improperly screened body parts can transmit diseases to the recipients including multiple infectious diseases such as HIV, Hepatitis B and C and syphilis.
