Guidant pled guilty
on June 12, 2002 to 10 felony charges related to an Ancure lawsuit filed by the Federal government and agreed to
pay $92.4 million to settle criminal and civil charges that it covered
up thousands of incidents in which a medical device used to treat
aneurysms in the aorta malfunctioned. According to the U.S. Department
of Justice, "The guilty plea in this Ancure lawsuit represents the largest amount ever paid by
a defendant for failing to report malfunctions of a medical device to
the Food & Drug Administration (FDA), and one of the first times there
have been felony convictions for such conduct."
Guidant is currently facing more than a dozen ancure lawsuits filed on behalf
of patients who died or were injured by Ancure. More Ancure class action lawsuits
on behalf of patients who received Ancure units are being considered at
this time.
